Middlesex County Land Records and Recording Procedures

Land records are public documents. In Middlesex County they include deeds, wills, deeds of trust, liens, releases, financing statements, and other instruments affecting real property. The Clerk of the Circuit Court is the official custodian of these records and is responsible for their proper maintenance and preservation.

If the fee you present for recording is short, the document will be rejected until additional funds are provided. If the recording fee is in excess of the required amount by up to $25, the document can be recorded, but the additional funds will be deposited into the Clerk's Office account and will not be refunded. Under Title 55.1 of the Virginia Code, a deed or other land instrument must be recorded to be effective against third parties. Recording gives constructive notice of the transaction to any person who later searches the records. If you close on a property but do not record, another buyer who does record could take priority over you under Virginia's race-notice recording statute.

VADeed Alert and Deed Fraud Prevention in Middlesex County

The Middlesex Circuit Court Clerk's Office encourages property owners to sign up for VADeed Alert. This free service sends you a notification any time a document is recorded in the Middlesex County land records that matches your name or property. Deed fraud is a real threat: someone can file a forged deed that appears to transfer your property to another party without your knowledge.

Middlesex County has also recently gone through its state-required real estate reassessment process. Representatives from Cowan, the county's contracted reassessment firm, worked throughout the community. Middlesex County Commissioner of Revenue: Assessments and Tax Records

The Middlesex County Commissioner of Revenue assesses all real estate and personal property in the county. The Commissioner maintains a record for each parcel of property in Middlesex County. These records include the owner of record for tax purposes, the assessed value of land and improvements, and the tax map number. The Commissioner also produces the Land Book each year, which the Treasurer uses to send tax bills. When ownership changes and a deed is recorded at the clerk's office, the Commissioner updates the tax records to show the new owner.
